1. Acceptance of Terms
By downloading or using the Ashrise app, these terms will automatically apply to you. You should make sure therefore that you read them carefully before using the app.
2. License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Ashrise app for your personal, non-commercial purposes on devices that you own or control. You may not sublicense, sell, resell, transfer, assign, or otherwise commercially exploit or make available to any third party the app or your access to it.
3. Relationship with Apple
You acknowledge and agree that these Terms are concluded between you and Moritz Kiefer only, and not with Apple Inc. ("Apple"). Moritz Kiefer, not Apple, is solely responsible for the Ashrise app and the content thereof. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Ashrise app.
In addition, Apple is not a party to these Terms and is not responsible for the app or its content. Apple has no obligation to you under these Terms. Notwithstanding the foregoing, Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
4. Educational and Supportive Tool Only
Ashrise is designed as a companion and supportive tool for personal recovery tracking and self-care. It is not a replacement for professional medical advice, diagnosis, or treatment. If you are experiencing a medical emergency or severe withdrawal, please contact emergency services immediately.
5. Subscriptions and Billing
Ashrise may offer an auto-renewable subscription called Ashrise Premium. Available billing periods, pricing, and any introductory offer are shown in the purchase flow before you confirm payment.
Payment will be charged to your Apple Account at confirmation of purchase. Your subscription renews automatically unless it is canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours before the end of the current period at the renewal price shown in the purchase flow.
If a free trial or introductory offer is provided and you do not cancel before that period ends, your subscription will automatically renew at the then-applicable paid rate. You can manage or cancel your subscription at any time in your Apple Account settings. If you previously purchased a subscription, you can also use the Restore purchases option inside the app.
While subscribed, Ashrise Premium unlocks paid app features such as the full phoenix progression, advanced journey features, exports, and premium support tools.
6. Warranties
Moritz Kiefer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Ashrise app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Moritz Kiefer.
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7. Product Liability and Claims
You acknowledge that Moritz Kiefer, not Apple, is responsible for addressing any claims by you or any third party relating to the Ashrise app or your possession and/or use of the app, including but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
8. Intellectual Property
In the event of any third-party claim that the Ashrise app or your possession and use of the app infringes that third party's intellectual property rights, Moritz Kiefer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
9. Third-Party Terms of Service
You must comply with applicable third-party terms of agreement when using the app. For example, if you use the app on a device provided by Apple, you must comply with the Apple Media Services Terms and Conditions in addition to these Terms. You are solely responsible for ensuring your use of the app does not violate any applicable third-party agreements.
10. App Availability and Updates
We are committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you're paying for.
11. User Responsibility
Ashrise stores your data locally on your device for privacy reasons. It is your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device.
12. Changes to These Terms
We may update our Terms of Service from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms of Service on this page. Changes are effective immediately upon posting.
13. Apple Standard EULA
Unless Moritz Kiefer provides a separate, superseding license agreement for the Ashrise app, your use of the app is also subject to Apple's standard Licensed Application End User License Agreement ("Standard EULA"). In the event of any conflict between these Terms and the Standard EULA, these Terms shall govern.
